A Milford woman, injured while working as a waitress at a chain restaurant in that city, has been awarded a $900,000 settlement for her injuries. The deal was reached Wednesday on behalf of Nancy Martino, who sought damages from Cracker Barrel Old Country Store and Restaurant in a case before the Workers’ Compensation Commission, according to Paul Ganim, Martino’s lawyer.
The 46-year-old Martino was working as a waitress in the restaurant on Research Drive in Milford when on Aug. 11, 1999, she was carrying dishes through the kitchen, according to Ganim.
Her foot allegedly got caught on broken floor tiles and she fell on the floor, he said. “She basically did a split and ended up on her back,” Ganim said.
Martino suffered serious injuries to her back and spine in the fall, Ganim said. He said she has trouble walking and now must rely on a wheelchair to get around.
“Her house had to be renovated so that she can navigate it on a wheelchair,” Ganim said. She is currently not employed.
Ganim said the floor tiles in the restaurant had been in poor condition for some time.
Julie Davis, a spokeswoman for Cracker Barrel, of Lebanon, Tenn., said the company was constrained by privacy regulations from commenting on the settlement
